Terms and Conditions

We have relationships with two types of consumers: Those who purchase our products and services ("customers" or "users") and those who subscribe to the groups created by our customers ("subscribers"). The following Terms and Conditions apply to one or both types of consumers:

For our Customers

When you create an account and sign up to manage groups on our site, you agree to the following:

  1. You will only send messages to your group that are of the type and nature that you advertise when you ask people to join your group.
  2. You will not send any messages that are unlawful, obscene, or defamatory; nor any message that violates an intellectual property rights (including but not limited to copyright) or any other rights of any third party.
  3. You will not send any message that facilitates any illegal activity.
  4. You will not send any message that contains any sexually explicit material.
  5. You will not send any message that is false, misleading, or is likely to mislead or deceive (including, without limitation, information about the source or author of the message).
  6. You will not send any message that promotes violence, discrimination, or any illegal activities.
  7. You understand that the text of your messages is visible to authorized employees of our company and there is no expectation of privacy in that regard. If during the normal course of business we realize that your messages violate these Terms and Conditions we will take steps that could include cancelation of your account.
  8. You will follow our requirements for wording of the "call to action" you use to ask people to sign up for your list.
  9. Availability of our Web site and the network we use to transmit and receive SMS (text) messages is conditioned upon factors beyond our control. There may be times when you will not able to send an urgent message (nor subscribers receive an urgent message) as promptly as you might wish.
  10. When all or portions of the SMS network is down, we will queue messages to be sent once services become available. It's possible, however, that even these queueing services will not be available. Users may have to re-send their message in that case.
  11. We are billed for every message we deliver to the SMS network, whether it reaches your subscriber or not. We will likewise bill you for every message we deliver to the network on your behalf. If a subscriber turns off his or her phone or goes out of coverage for a long period of time, the SMS network will eventually give up and discard the message. There are other circumstances under which your message may not reach your subscriber.
  12. Charges for our services will appear on your bill as TEXTINGMANAGER.COM.
  13. Our fees are based on an underlying fee structure over which we have no control. Our prices may change if that fee structure changes.
  14. You are not billed for messages we send to your subscribers as part of the opt-in, opt-out, or help process.
  15. You may cancel your service at any time. The monthly fees you pay for your groups cover services that you use whether you send any messages during the month or not and thus are not refundable once charged to your credit card or otherwise paid. Message credits included in your monthly plan and which expire if not used are not refundable. Message credits you purchase separately are refundable if not used when you cancel your service.
  16. When you cancel your service, or if you do not pay your monthly fees within 30 days of when they are due, all of your groups are deleted and your group names become available to another user. As a result, we cannot restore your group members if you decide to rejoin our service at a later date.

For our Subscribers

When you subscribe to a group that is managed by one of our customers we do not bill you for any of our services, but std/other charges may apply to messages you send and receive as determined by your mobile phone provider.

You can cancel your membership in any group by replying to a message from us with the word STOP or texting STOP to 564646. Std/Other charges may apply.
